These Terms of Service ("Terms") are a legal agreement between MediaGen ("we", "us", or "our") and you regarding access to and use of our services, including AI content generation, credit purchases, Pro subscriptions, video downloader tools, and related features (collectively, the "Services").

By accessing or using MediaGen, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully before proceeding. If you do not agree, do not use the Services.

AI output is a starting point for your review. We do not guarantee reach, virality, rankings, or business outcomes.

MediaGen offers AI-powered social media copy generation for platforms such as TikTok, YouTube, Instagram, Facebook, X, and others.

We may also offer auxiliary tools such as video downloaders or transcription. Availability may change over time.

Output may be inaccurate, incomplete, or unsuitable for your audience. You are solely responsible for how you use, edit, or publish any output.

To use generation features, you must register for an account with accurate information and keep your credentials secure.

You may sign in with email or, where available, third-party authorization such as Google OAuth. By using third-party login, you authorize us to receive the minimum information needed to verify your identity.

You must be at least 13 years old (or the minimum age in your jurisdiction). If you are under 18, you may use the Services only with parental or guardian consent.

We may suspend or terminate accounts that violate these Terms, applicable law, or that pose security or abuse risks.

You agree not to:

• Use the Services for any illegal purpose or in violation of applicable law.
• Submit content that infringes others' rights or violates privacy.
• Attempt to reverse engineer, scrape, overload, or disrupt the Services.
• Misrepresent AI output as factual medical, financial, or legal advice.
• Use the Services to exploit or harm minors.
• Introduce viruses, malware, or harmful code.
• Harass, abuse, or threaten other users or third parties.

Prohibited content — you must not use the Services to generate, request, or attempt to produce:

• NSFW, sexually explicit, pornographic, or obscene text or media descriptions.
• Non-consensual intimate imagery, deepfakes intended to harass or defame, or content that sexualizes minors in any way.
• Content that promotes violence, hate, or illegal activity through AI generation features.
• Any output that violates applicable law or third-party rights, including using prompts or inputs to circumvent these restrictions.

We use automated safeguards, including Creem Content Moderation, to enforce these rules. We may refuse generation, suspend accounts, or report activity where required by law.

You retain ownership of topics and other input you submit ("Input"). Subject to these Terms, you own the output generated for your account ("Output").

You grant us a limited, non-exclusive license to host, process, transmit, and display Input and Output solely to operate, secure, improve, and support the Services, comply with law, and enforce these Terms.

You represent that you have all rights necessary to submit Input and that your use complies with applicable law and platform rules.

MediaGen, our branding, site design, software, and non-user content are owned by us or our licensors and protected by intellectual property laws.

Some features require credits or paid plans. Pro subscriptions offer expanded or unlimited generations subject to fair use and these Terms.

Prices, credit amounts, and availability are shown at checkout and on the Pricing page and may change.

Payments are processed by third-party providers such as Creem. Their terms and privacy policies apply in addition to ours.

Unless required by law, purchases are generally non-refundable once credits are delivered or used. See our Fulfillment Policy for delivery, refund, and cancellation details.

Contact support@mediagen.com if you believe a charge was made in error.

You may stop using the Services at any time.

We may suspend or terminate your access at our discretion if we believe you violated these Terms or engaged in conduct that may harm MediaGen or other users.

Upon termination, obligations incurred before termination remain in effect.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted, secure, or error-free operation, or that output will meet your expectations or comply with every platform policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50).

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law rules, except where mandatory local law provides otherwise.

Disputes should first be raised with us at support@mediagen.com. Where permitted by law, you agree to resolve disputes individually and not as part of a class action.

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on MediaGen.com and update the "Last updated" date.

Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Services.
